Terms of Service
These terms govern your use of Amulet Creators at https://amuletcreators.com (the “Platform”), operated by Amulet Games D.B.A Amulet Creators (“we”, “us”). By creating an account or posting content for a campaign, you agree to them. If you do not agree, do not use the Platform.
1. What the Platform is
Amulet Creators connects short-form video editors with brands and music artists who want content made. Brands and artists fund campaigns. Editors choose which campaigns to make a video for, post that video on their own social accounts, and are paid based on the terms of that campaign.
We contract with brands and artists in our own name and separately engage editors as independent contractors. Editors are not our employees, and no editor is an employee, agent or partner of any brand or artist using the Platform.
2. Accounts
There are three kinds of account, and they are opened differently:
- Editors sign up directly. Applications are reviewed before an editor appears in the roster that brands browse.
- Artists and labels sign up directly and can fund campaigns once their balance is topped up.
- Brands are onboarded by us by arrangement. There is no self-service brand signup; write to onboarding@amuletcreators.com.
You are responsible for the accuracy of what you tell us and for everything done through your account. Keep your password to yourself and tell us promptly if you think someone else has it. You may not create an account on someone else’s behalf without their authority, or hold more than one editor account.
3. Eligibility and age
You must be at least 18 to hold an account that receives payment. If you are under 18 but old enough to use the relevant social platform, a parent or legal guardian must open and hold the account, accept these terms, and be the person we pay. We may ask for evidence of this and may withhold payment until we have it.
You must also meet the minimum age and eligibility rules of every social platform you post to.
4. Campaigns and payment
Every campaign states its rate, the maximum any single post can earn, any weekly cap, its requirements and its remaining budget before you commit to it. Those terms are what apply to that campaign.
Our fee
We keep a percentage of what a campaign pays for your post. That percentage is shown to you on the campaign page before you post, and it varies by campaign and by editor. What you see is what applies. Where a cap limits a post’s earnings, the cap applies to your share.
When you get paid
Earnings accrue as views are recorded and become payable once a submission is approved. Approval is not automatic: we verify that a post meets the campaign requirements. We may reject a submission that does not, and we may withhold or reverse payment for a post that breaks section 5.
A campaign can only pay out what remains of its budget. Where a campaign is exhausted, later submissions may not be payable even if they meet every requirement.
5. Content rules
By submitting a post to a campaign, you confirm that:
- You made the post yourself and it is genuinely on the account you submitted it from.
- You have not bought, botted or otherwise artificially inflated views, likes, comments, shares or followers.
- You have not hidden engagement metrics on the post, and you will keep it public for the period the campaign specifies.
- You own or are licensed to use everything in the video, and posting it does not infringe anyone’s rights.
- You have followed the campaign brief, including any watermark, sound or snippet requirement.
- You have disclosed the commercial relationship wherever the platform you posted to, or the law where you live, requires it.
We may refuse or remove a submission, withhold payment, or close an account for breaking these rules. Where we do, we will tell you why.
6. Rights in your content
You keep ownership of everything you make. By submitting a post to a campaign, you grant us and the brand or artist funding that campaign a non-exclusive, worldwide, royalty-free license to view, share and reference that post for the purpose of running and reporting on the campaign, for as long as the campaign runs and for a reasonable period afterwards.
If a campaign asks for broader rights than that — for example to run your video as a paid advertisement — those rights will be stated in the campaign brief, and posting to that campaign grants them.
7. Brands and artists
If you fund a campaign, you confirm you have the rights to the product, track or material you are asking editors to feature, and that the brief does not ask editors to do anything unlawful or against the rules of the platforms they post to.
Campaign budgets are prepaid credit against delivery. Funds you add are applied to campaigns you run and are not a deposit held on your behalf. We may refuse or stop a campaign that breaches these terms.
8. Third-party platforms
Posting happens on TikTok, YouTube, Instagram and similar services. Your use of those services is governed by their terms, not ours. We do not control them, and we are not responsible for their decisions — including if they remove your post, restrict your account or change how views are counted. Connecting an account to us does not change your relationship with them, and you can disconnect at any time.
9. Suspension and closing your account
You can close your account at any time by writing to legal@amuletcreators.com. Earnings already approved remain payable. We may suspend or close an account that breaches these terms, or where we are required to by law.
10. Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not promise that any campaign will reach a given number of views, that any application will be approved, or that the Platform will be uninterrupted or error-free. Reach and performance figures shown on the Platform are estimates based on past data, not guarantees.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE OR LOST OPPORTUNITY. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS WE PAID OR OWED YOU IN THE THREE MONTHS BEFORE THE CLAIM, OR (B) $100.
Some states do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing here limits liability that cannot be limited by law, including for fraud.
12. Copyright and takedowns
We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act. Send notices to copyright@amuletcreators.com, including identification of the work and of the material you say infringes it, your contact details, a statement that you believe in good faith the use is not authorized, and a statement under penalty of perjury that your notice is accurate and that you are the rights holder or authorized to act for them.
We terminate the accounts of repeat infringers. If your content is removed in response to a notice, you may send a counter-notice to the same address.
For editors: Much of what gets made here is derivative — footage from shows, films and games belonging to someone else. Being paid for a post does not give you rights in that footage that you would not otherwise have, and a campaign brief is not a license to it. Whether your edit is lawful where you live is your responsibility, and a takedown against your post is between you and the rights holder.
13. Changes
We may change these terms. Where a change is material we will give notice before it takes effect, and continuing to use the Platform after that means you accept it. Changes never apply retroactively to a campaign you have already posted to.
14. Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located there for any dispute arising out of these terms.
